1 - The website www.monpetitmeublefrancais.com is published by MON PETIT MEUBLE FRANÇAIS SARL, a limited liability company with a capital of € 5,000, whose head office is located in Rennes (35000), 1 rue François Charles Oberthür, registered under the unique identification number 820502631 RCS Rennes (MON PETIT MEUBLE FRANCAIS).
MON PETIT MEUBLE FRANCAIS is the author of the offer for sale on the products presented on its website: www.monpetitmeublefrancais.com (hereinafter the "Website").
The offices, showroom and stocks are located at 12, rue de l'abbaye, 53190 Landivy, France.
2 - The present General Conditions of Sale apply between MON PETIT MEUBLE FRANCAIS and the Customer of the Website. 4.2. The Order will only be considered definitive as from the date of shipment by Mon Petit Meuble Français of a complete Order Confirmation referred to in article 5.1. The sale of the Product (s) will not be noticed until the full payment of the corresponding price by the Customer.

ARTICLE 5 - ORDERING TERMS - PRICE OF PRODUCTS

5.2. For deliveries of Products outside French territory, the provisions of the General Tax Code relating to VAT will apply. 5.3. Mon Petit Meuble Français reserves the right to modify the prices at any time and without notice but the price applicable to the Order of the Customer will remain the one indicated in the summary of his cart of purchase during the validation of his order. ARTICLE 6 - PAYMENT
6.1. Extent of payment
The price of the Products and the costs of logistical preparation and delivery are payable in full by the Customer at the time of placing the Order. - By bank transfer to the order of Mon Petit Meuble Français (bank details are being issued at the time of placing the Order). In case of non recieving the exact funds within 7 days after confirmation of the Order by Mon Petit Meuble Français or in case of rejection of the transfer by the bank, Mon Petit Meuble Français reserves the right to cancel the Order.
The Website is using one of the most efficient SSL (Secure Socket Layer) encryption security systems, in order to protect all sensitive data related to means of payment. When the customer is paying, his bank details are encrypted with the HTTPS protocol and transmitted to servers only able to decrypt them. 6.3. Failure to pay and retention of title: The ordered Products remain the property of Mon Petit Meuble Français until final and full payment of the sale price. ARTICLE 7 - DELIVERY
7.1. Place of delivery
As a matter of principle, the delivery of the Products will take place, after registration of the payment of the Order, to the delivery address indicated by the Customer during the placing of the Order. An email will be sent to the Customer to announce the shipment date of the Products.
7.2. Participation in preparation and delivery costs
All logistic costs (excluding V.A.T for foreign countries) are included in the price of the article. This extra cost is set on the Website for online payment for some destinations. 7.3. Delivery time
The date of shipment will be indicated to the Customer by the personalized order confirmation. The average time for shipment is thirty (30) working days from the Order of the Product, except particularity indicated to the Customer in the order confirmation. It is specified that each piece of furniture offered for sale on the Website is finished after the order confirmation. 7.4. Place of delivery: A delivery is considered as made as soon as the Customer takes physical possession of the Product on the place of delivery agreed with the Customer during the placing of the Order and during the appointment fixed with the carrier. 7.5. Withdrawal of Products
In case of absence of the recipient during the delivery, the carrier will deposit a notice of passage to the delivery address indicated by the Customer. The Products must then be recovered or withdrawn at the address and in the manner indicated by the carrier. In the absence of withdrawal within the deadline set by the carrier, the Products will be returned to Mon Petit Meuble Français, which reserves the right to refund the price to the Customer, the shipping costs remaining the responsibility of the Customer.
7.6. Effect of delivery
The transfer of risks occurs upon delivery, at the moment when the Customer physically takes possession of the Products at the delivery address indicated by the Customer, or from the carrier. ARTICLE 8 - COMPLIANCE - GUARANTEE - RIGHT OF WITHDRAWAL
8.1. Product conformity
The legal guarantee of conformity mentioned in articles L.217-4 to L.217-14 of the Consumer Code and relating to the defects of the thing sold, mentioned in articles 1641 to 1649 and 2232 of the Civil Code, shall apply in accordance with to the law. In case of legal warranty action, the consumer:
- has a period of 2 years from delivery of the property to act,
- can choose between the repair or replacement of the property, subject to the cost conditions provided by Article L.217-9 of the Consumer Code
- is exempted from providing proof of the existence of the lack of conformity of the property during the twenty-four (24) months following the delivery of the property. The legal guarantee of conformity applies regardless of the commercial guarantee.
In the case where the consumer decides to implement the guarantee against hidden defects of the thing sold as provided for in Article 1641 of the Civil Code, he may choose between the resolution of the sale or a reduction of the selling price in accordance with in Article 1644 of the said Code.
8.1.1. In accordance with Article L.111-1 of the Consumer Code, Mon Petit Meuble Français aims to inform the Customer and to put him in a position to know the essential characteristics of the Product. According to Article L.217-12 of the Consumer Code: "The action resulting from lack of conformity is prescribed by two years from the delivery of the property."
8.1.3. In application of articles L.217-9 and L.217-10 of the French Consumer Code, the repair of the consequences of the lack of conformity or the hidden defects, duly established and confirmed as such by Mon Petit Meuble Français includes, at the Consumer's choice, unless this desire entails a cost that is manifestly disproportionate considering the value of the property or the importance of the defect, compared to the other modality, the repair or replacement of the Product.
If the repair and replacement of the property are impossible, the Customer can return the property and get the price back or keep the property and get a part of the price. In these different cases, the Customer must contact the Customer Service and agree on the return terms of the Product concerned. Insofar as it is founded, the application of the provisions of Articles L.217-9 and L.217-10 of the Consumer Code, takes place at no cost to the buyer.
8.2. Commercial guarantee
All Products benefit from an extended 3-year warranty given by Mon Petit Meuble Français due to the quality of the Products distributed in general. 8.3. Guarantee of hidden defects
According to Article 1641 of the Civil Code: "The seller is bound by the guarantee for reasons of hidden defects of the thing sold which render it unsuitable for the use for which it is intended, or which so diminish this use that the buyer does not would not have acquired it, or would have given a lower price, had he known them.

According to Article 1645 of the Civil Code: "If the seller knew the defects of the thing, he is held, in addition to the return of the price he has received, all damages and interest to the buyer."
According to article 1646 of the Civil Code: "If the seller was unaware of the defects of the thing, he will be held only to the return of the price, and to refund to the purchaser the costs incurred by the sale".
According to article 1647 of the Civil Code: "If the thing that had defects perished as a result of its poor quality, the loss is for the seller, who will be liable to the buyer for the restitution of the price and other compensation explained in the two previous articles. But the loss arrived by fortuitous event will be on behalf of the buyer.
According to article 1648 of the Civil Code: "The action resulting from the latent defects must be brought by the purchaser within two years from the discovery of the defect".
8.4. Right to retract
8.4.1. Mon Petit Meuble Français considers that any Customer who is not satisfied with the Products ordered must be able to exercise his right of withdrawal, without penalty, in the best conditions.
In accordance with Articles L.221-18 et seq. Of the Consumer Code, the statutory period of the right of withdrawal is fourteen clear days from receipt of the Product.
The Customer returning the Product as part of the exercise of his right of withdrawal, has the right to refund the price of the Products ordered and one-way delivery costs. The refund will be made, at the latest, within seven days from the date on which Mon Petit Meuble Français recieves the refused furniture. The refund will be made by transfer to the Customer's bank account. Only the return or exchange of the complete Products and in a perfect state of resale, not soiled, undamaged, not worn will be accepted. To make it easier to take your request into account and speed up the refund, we recommend that you send us the return slip carrefully filled with all necessary information. The costs of returning the goods of the Product remain the responsibility of the Customer, except for the hypothesis of a lack of conformity or proven hidden defects of the Product.
8.4.3. In case of use of the right of withdrawal for only part of the Order, only the price invoiced for the returned Products will be refunded.
8.4.4. Exceptionally, the right of withdrawal may not be exercised for contracts listed in Article L.221-28 of the Consumer Code, including contracts for the supply of goods made to the consumer's specifications or clearly personalized. 8.5. Return procedure

13.1. Partial disability

13.5. Force majeure
Execution by Mon Petit Meuble Français of all or part of its obligations, including delivery, will be suspended in case of occurrence of a fortuitous event or force majeure that would hinder or delay the execution. These include, without limitation, war, riots, insurrection, social unrest, and large-scale general strikes.
Mon Petit Meuble Français will inform Customers of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. ARTICLE 14 - SUSPENSION - TERMINATION

The General Conditions of Sales are subject to French law. Only the French version of these Terms and Conditions of Sales shall prevail. In case of difficulty occurring during the Order, the delivery of the Products and more generally the execution of the sale, the Customer will have the possibility, before any legal action, to seek an amicable solution, in particular with the help from a consumer association or any other council of its choice.
Any dispute that may arise from the interpretation or execution of the General Conditions of Sale and its consequences will be brought before the competent courts.
The General Terms and Conditions of Sale also apply in the relationship with any user of the Website who has not placed an Order, particularly with regard to Articles 11 to 15.
